We respect the privacy of your data and are committed to being transparent about how we handle it.
We are Reviva Softworks Ltd, a UK company. We created and operate the Sleepwave mobile app (referred to as Sleepwave or the app). Our address is at 10c Printing House Yard, Hackney Road, London, United Kingdom, E2 7PR and we can be contacted at support@sleepwave.com.
This Privacy Policy details how Sleepwave collects, uses, stores, transfers and discloses data obtained from our interactions with you. Here, we also highlight the choices you can make about how your data is managed, including revoking your consent.
We have designed Sleepwave to collect minimal personal data and to keep you in control. Sleepwave does not require you to create a personal account or sign in to use the app. You can use Sleepwave anonymously without having to provide a name, username or e-mail address.
The table below describes the data we process about you as a user of the app, and how we process it.
Microphone access is a requirement for the app to work. If you activate Sleepwave for sleep tracking, wavescapes or sound recordings, then Sleepwave will ask for access to the microphone of your device while you are using the app. You cannot run a sleep tracking or wavescape session or use any of the associated features without microphone access.
Sleepwave’s sleep tracking and wavescapes features work by emitting an inaudible high-frequency tone from your phone’s speakers. The microphone is used to pick up the reflections of this tone and the processing is done on the device. If you provide access, the app will process the resulting data to generate the sleep analysis report on the device that you use to run Sleepwave.
Sleepwave does not collect or store your audio recordings or sleep data. This data is processed and stored locally on your device.
When you run Sleepwave, you are assigned an anonymous user unique identifier (UUID) that is used to track your usage of the app and your interactions with various features. This will also include anonymous aggregate data such as device identifiers of the devices, device characteristics, the country or city your device is located in, the version of Sleepwave installed on your device, the operating system version that your device is running on and whether or not you have access to our premium features. This does not contain information that can personally identify you. A summary of these results is sent to our secure servers.
When you send an email to our support inbox Sleepwave will have access to any content included within the email including but not limited to your name, email address, and contents of that email you have exchanged with us.
From time to time, we may ask for your feedback on Sleepwave and other services. Your participation is entirely optional and does not affect your use of the Sleepwave app.
When designing and executing our survey, it is our policy to take all necessary steps to ensure that the personal information you provide is processed fairly and lawfully.
We collect survey data which can include personal information such as your name, email address, age, occupation, lifestyle interests, app preferences, and purchasing decisions. We ask for your contact details in the event we need to follow up with you. We may also contact you about participating in future questionnaires.
If you change your mind, you are entitled to ask that part, or all, of the record of your involvement in the survey be removed and destroyed.
This table sets out how we use the data we collect. We are required by law to tell you what the legal basis for each use is, so we’ve done that too.
* Legal basis definitions:
Performance of contract means the performance of our contractual promise to make the app available to you.
Legitimate interest means conducting our business so we can give customers a great product experience.
Consent means express consent (usually through choices you make in the app).
Please note the following in relation to how we use your data:
If you share your sleep records with others: If you choose to share your sleep records with us via non-private platforms such as on social media or by email, or with medical professionals, they are consequently not to be considered private and Sleepwave is not liable for any unauthorized handling/use of these records.
Retention of survey results: If you have provided us personal data as part of a survey (first name, email address, user experience survey) you have opted in to, we will only retain your personal data for as long as necessary to fulfil the research and analytical purposes that we have collected it for. We may aggregate and anonymise your survey data to share with reputable third-party parties, for promotional, marketing and PR purposes.
We work with reputable, established third party partners who provide us with analytics, cloud and customer management platform services. We only provide these third parties with access to information that is necessary to perform services for us in connection with the Sleepwave app or to comply with the law. We do not give these third parties permission to use this information for any other purpose except to provide services to us in connection with the Sleepwave app.
We also make sure that our contracts with our partners will require them to protect your data in a manner that is consistent with the Privacy Notice.
We disclose your personal data to the following technology platforms:
Please also note the following, regarding disclosure of data:
We will not share your data: Except as described in this section, we will not disclose any of your personal data to third parties, unless you have given us explicit consent to do so and we will never sell your data to third parties.
Aggregated data: We may publish aggregated, anonymized statistics and insights which cannot be used to identify you, within the app, on our website, our various social media platforms or in publications.
Special circumstances: We may share your personal information in the following circumstances:
Our approach: We will always retain personal data for as long as reasonably necessary. We take into account legal, regulatory, tax, and accounting requirements, and good management practices.
In determining the retention period, we consider the amount, nature and sensitivity of the personal data, and the risk of harm from unauthorized use or disclosure. We will also consider the purposes for which we process your data and whether we can achieve them by other means.
Retention periods: We will process your data for as long as you are a registered user of the app.
If you unsubscribe or delete your user account, we will keep your data for another 12 months, in case you choose to resubscribe, and for legal reasons.
We also have a rolling data deletion policy for inactive users: if you stop using the app and you don’t have an active subscription (because you never signed up, or we terminated your use of the app or you cancelled your subscription), we will anonymise all your personal data (if any) within 12 months after your last activity. If you do have an active subscription, but haven’t used the app for a while, we won’t delete your data in case you want to start using the app again.
Prior deletion: You may also delete your Sleepwave account including your sleep records, via the profile settings or by directly requesting deletion from us.
Information posted by you: On our social media platforms, you can share information with us and other users. These communities are open to the public and should not be considered private. This information may also show up on search engines. If you accidentally post personal information on these platforms and would like it removed please email us on support@sleepwave.com to request we remove it. In some cases, for technical reasons, we may not be able to remove such information.
Anonymous and aggregate data: Anonymous and aggregated information, neither of which identifies you personally, may be stored indefinitely for research and analytics purposes.
Personal data that you input into Sleepwave will be visible in the app interface including the profile screen and in the records that you create with the app. You can also ask us what personal data we have about you by contacting us on support@sleepwave.com.
You can modify, correct, delete and update your personal data and permissions in the app profile settings. Once deleted, your personal data including your account details, snoring stats and audio recordings cannot be reinstated. Please note that content you have shared with others, for example medical professionals, via the app or otherwise, may remain visible after you have deleted your account.
You can minimise or suspend the processing of your personal data, by removing permissions in the app or phone settings, deleting your data and recordings via the Track tab, or by deleting the app. If you have done all that, and in addition want us to delete all your personal data without retention periods, contact us at support@sleepwave.com. You can also contact support if you want us to hold data for longer than the stated retention periods (for example to exercise or defend a legal claim).
You may object to processing of your personal data where we process it based on legitimate interest. We will assess your objection and tell you whether we have any legitimate grounds or legal justification for continued processing.
You may withdraw consent at any time, if you have opted in to any services or targeted communications. You can also change your marketing preferences at any time or opt out from marketing communications by clicking on the ‘unsubscribe’ link in any marketing email or by emailing support@sleepwave.com. This will not affect the lawfulness of any processing carried out before you withdraw your consent.
You have the right to make a complaint to your local data protection authority.
We may update this Privacy Notice from time to time. We might update it due to changes to our services or changes in the law.
Your continued use of Sleepwave after any changes made to the Privacy Notice constitutes your acceptance of the Privacy Notice. If you object to any changes to this Privacy Notice you should stop using Sleepwave.
